Ministerial Correspondence and Public Enquiries Unit Department of Health and Social Care 39 Victoria Street London SW1H 0EU dhsc.publicenquiries@dhsc.gov.uk 0300 790 4007 Madam/Sir, I presume that the Department of Health is the appropriate body to which I should complain regarding the General Medical Council and its failings. I am embroiled in a long campaign concerning the antics of a practitioner, Dr Patricia Turner, and associated, rather alarming misconduct; the GMC refuses to even acknowledge the issue, despite admitting that it has been in receipt of relevant documentation, seemingly well 'within time' - I was employed, by Staffordshire County Council, as a schoolteacher, at the time of the misconduct and the GMC has acknowledged (see below) that the Doctor enquired as to the state of my exercise books (sic) but, within the same paragraph, I advised the GMC (see also below) that Patricia had 'sworn the vow' that I "never work again", the clearest abuse of power. As to motive, gender does appear to play a role; my GP, probably declaring as male, considered my stance as 'healthy' whereas Patricia, an apparent heterosexual female, considers I have challenged the authority of my, male, superordinate - this may well be evolutionary biology playing its natural part, but I haven't challenged the 'dominant male', and, whatever, Pat's antics are the clearest form of misconduct. I maintain that the submitted evidence is 'necessary and sufficient' - shouldn't something be done? Isn't the GMC at fault? David Austin mail@dwaustin.net fpdcomplaintscorresp@gmc-uk.org 01/21/23 06:17 Dear Sean, I remain very disappointed with the GMC's response; the Council maintains that insufficient evidence of misconduct has been presented, whereas my position is that Dr Turner's vow, with witnesses, that I "never work again" demonstrates a clear wish to apply her powers in a rash and entirely inappropriate manner - a 'cognitive failure' is very likely. The GMC appears to be yet another corrupt British public institution - do rectify the situation. DWAustin mail@dwaustin.net From: FPD Complaints & Correspondence (FPDComplaintsCorresp@gmc-uk.org) Date: 01/20/23 16:28 To: mail@dwaustin.net Subject: Your GMC correspondence Our reference: E1-3572230314 Private: Addressee Only Mr David Austin Dear Mr Austin  Thank you for your email. I have looked through our records and I can see that you first raised concerns with us regarding Dr Patricia Turner in October 1999. Our triage team considered your concerns under the reference 1999/2100/01. Though we no longer hold the documents you provided or our response to you on record, I have found the following summary of your complaint and our decision: Allegation The complainant initially contacted us in September 1999. His allegations were unclear. It appears that the complainant attended a meeting/hearing in relation to his employment as a teacher. He states that the doctor made an attempt to discredit him and asked him if his exercise books were marked. Decision This enquiry has been closed. The complainant was asked for further information on more than one occasion but no response was received, so the matter was closed. Over three years later, the complainant sent in further correspondence but he was advised that he had not provided any further information that would allow us to consider the complaint; he was advised of this several times. The complainant contacted us again in 2006, even coming to our office in person, but he was again advised that he had not provided us with any information or evidence that would allow us to take any further action. I can also see that we considered concerns from you about Dr Turner in June 2022 under the reference E1-3572230314. This complaint was also closed, as Dr Turner is no longer on the medical register. Dr Turner left the register in March 2010. As our powers focus on a doctor’s registration, we are not able to take any action once they are no longer registered. You can view the doctor’s registration information on our website athttps://www.gmc-uk.org/doctors/1236303 I hope this is helpful and I am sorry that we cannot consider this matter further. I have also reviewed my records and can confirm that my first contact with the GMC was soon after the notorious August Ambush in 1997, well 'within time'. Since then, the GMC have either ignored my correspondence, lost my correspondence or prevaricated, sometimes asking for more details, when there are none, or claiming that there is no evidence of misconduct, when this must be the clearest case of trashing an individual's prospects that is imaginable. I again give the relevant account (below) and ask the GMC to review its position and reflect on its own 'lack of appreciation' of the seriousness of this case. "Called to a meeting by Staffordshire County Council, I made the observation that the occasion was unfairly constituted (lacking an association representative) but that did not bother the personnel officer present (who seems able to indulge in any shenanigan, free of accountability) and did not deter Pat Turner from indulging in the most mean attempt to discredit me. She had already asked if my exercise books were marked (a bloody cheek - I could even boast a homework record for each child!) and now she began to attack my grammar and dress (traditional - consistent with that of the headteacher). Astonishingly, she made reference to the headteacher's imminent retirement (why, I've no idea - I have not acted against the interests of the gentleman and even recommended him through the chair to the governors and 10 Downing Street for an award) and expressed the determination that I "never work again"! Is this conduct not gratuitous?" DAustin
